A. The Council may adopt by resolution an industrial pretreatment enforcement response plan (enforcement response plan) which shall describe the enforcement procedures that may be used to carry out the provisions of this chapter. The City Manager may approve an enforcement response guide to carry out the provisions of the enforcement response plan.

B. The enforcement response plan shall describe in detail the system of escalating levels of penalties described in WVMC 13.16.260.

C. A person challenging an enforcement decision pursuant to WVMC 13.16.230 through this section may protest the enforcement decision as described in the enforcement response plan. (Ord. 2-2023 § 1 (Att. A), 2023.)
