13.16.240 Enforcement penalties.
A. Violations of this chapter, the requirements of a wastewater discharge permit, or the requirements of a wastewater discharge permit, or the requirements of an order issued under this chapter, may result in:
1. Assessment of civil administrative penalties as established by Council resolution.
2. Assessment of civil penalties in at least the amount of $1,000 a day for each violation by industrial users of pretreatment standards and requirements.
B. The City Manager may initiate any other enforcement action as outlined in this chapter and in the enforcement response plan. Each day on which a violation occurs or continues shall be deemed a separate offense. Failure to pay an administrative or civil penalty within thirty (30) days following a final determination regarding the penalty is grounds for permit revocation or termination of an industrial user’s discharge. In addition to the administrative and civil penalties, the City Manager may recover other costs associated with the enforcement activities, including sampling and monitoring expenses.
