This section is included in your selections.

A. Each building is categorized based on the primary activity of the establishment that occupies the building or site. The primary activity will be established by the relative number of transactions or visits from the general public rather than the volume of sales or dollars.

B. Where distinct and separate businesses are located within a single building and share a common entrance from the parking area, the businesses shall be categorized and charged as a single business using the category which fits a majority of the businesses within the building.

C. Where distinct and separate businesses in any commercial zoned area are located within a single building and each has a separate entrance from the parking area, the businesses shall be categorized and charged as separate businesses, with a single billing provided to the responsible person for other municipal utilities for that building, except in manufacturing zones as provided in subsection G of this section.

D. The gross square footage for any incidental use within a building shall be included in the total gross square footage for the building. Example: an office in a retail store shall all be classified retail; the shipping and receiving area of a retail outlet that is predominantly retail shall all be classified retail.

E. Where categories are not clear, the City shall identify the most similar category and the rationale for such a determination. Any aggrieved party may utilize the appeal procedures of this Code to seek adjustments or change as identified in this Code.

F. Where two potential trip generation rates may be applied to a single category such as elderly care facilities, the calculations shall be made utilizing both methods, and the lesser of the two fees established as the applicable fee for the development.

G. Manufacturing Zoned Properties and Industrial Lease Space buildings shall be billed based on the total gross square footage of the entire building, with the ITE Code 140 Manufacturing assigned for all areas. Vacancy credit shall be available for any unoccupied leasable areas.

H. Public Utility or private utility occupancies that do not have active structures shall be classified as Public Service and shall receive the commercial minimum billing as provided in this chapter.

I. Where multiple buildings in single ownership occur on a single parcel, the billing for transportation and storm water will be based on the individual occupancies of the structures, their respective ITE categories and average trip generation, and billed to the responsible person as a single composite billing.

J. Condominiums in place in Wood Village at the time of the adoption of this code in May of 2012 shall all be treated as multifamily for purposes of this section. Any new condominium construction shall be classified and billed in accord with the appropriate categories of the ITE.
