A. Industrial users shall file with the City Manager an industrial waste discharge permit application in the form prescribed by the City Manager.

B. Non-permitted, existing industrial users shall apply for an industrial waste discharge permit within sixty (60) days after being notified by the City Manager.

C. Renewals. Existing permitted industrial users shall reapply at least ninety (90) days before the expiration date of their industrial waste discharge permit.

D. Modifications.

1. Existing permitted industrial users proposing facility expansion, production increase or process modification which may result in a change in the character of pollutants to be discharged or which may result in new or increased discharge which may exceed the condition of their permit, shall apply for a new permit at least ninety (90) days prior to changing the discharge to the sanitary sewerage system.

E. Proposed new industrial users shall apply at least ninety (90) days prior to connecting to the sanitary sewerage system.

F. The applicant for a permit shall provide the following information:

1. Name, address and location of the industrial user.

2. Standard industrial classification (SIC) number according to the Standard Industrial Classification Manual, Office of Management and Budget, 1987, as amended and the North American Industry Classification System (NAICS) number according to the NAICS Manual.

3. Wastewater constituents and characteristics including but not limited to those mentioned in this chapter. Sampling and analysis shall be performed in accordance with WVMC 13.16.140.

4. Time and duration of discharges.

5. Average daily and instantaneous peak wastewater flow rates, in gallons per day, including daily, monthly and seasonal variations. All flows shall be measured unless other verifiable techniques are approved by the City Manager due to cost or non-feasibility.

6. Site plans, floor plans, mechanical and plumbing plans and details to show all building sewers, sanitary sewer connections, inspection of the maintenance access, sampling chambers, and appurtenances by size, location and elevation.

7. Description of activities, facilities, and plant processes on the premises including all materials that are or may be discharged to the sanitary sewerage system.

8. For existing plants at time of adoption of ordinance codified in this chapter, the nature and concentration of any pollutants or materials prohibited by this chapter in the discharge, together with a statement regarding whether or not compliance is being achieved with this chapter on a consistent basis and if not, whether additional operation and maintenance activities and additional pretreatment is required for the industrial user to comply with this chapter.

9. Where additional pretreatment and operation and maintenance activities will be required to comply with this chapter, the industrial user shall provide a declaration of the shortest schedule by which the industrial user will provide such additional pretreatment and implementation of additional operational and maintenance activities. The completion date in this schedule shall not be later than the compliance date established for the applicable pretreatment standard. The following conditions apply to this schedule:

a. The schedule shall contain increments of progress in the form of dates for the commencement and completion of major events leading to the construction and operation of additional pretreatment required for the user to meet the applicable pretreatment standards (e.g., hiring an engineer, completing preliminary plans, completing final plans, executing contracts for major components, commencing construction, completing construction, and others).

b. No increment referred to in subsection (F)(9)(a) of this section may exceed nine months.

c. Not later than fourteen (14) days following each date in the schedule and the final date for compliance the industrial user shall submit a progress report to the City Manager, including, as a minimum, whether or not it complied with the increment of progress to be met on such date and, if not, the date on which it expects to comply with this increment of progress, the reason for delay, and the steps being taken by the industrial user to return the construction to the schedule established. In no event shall more than nine months elapse between such progress reports to the City Manager.

10. Disclosure of the type and amount of raw materials utilized by the industrial user (average and maximum per day).

11. Any requests for a monitoring waiver (or a renewal of an approved monitoring waiver) for a pollutant neither present nor expected to be present in the discharge based on WVMC 13.16.140.

12. Permit applications shall be signed by a principal executive officer of the industrial user or per WVMC 13.16.150(B), and a qualified engineer where required.

13. The permit application shall include the certification statement of WVMC 13.16.150(A)

G. The City Manager will evaluate the complete application and data furnished by the industrial user and may require additional information prior to granting or denying an industrial waste discharge permit. (Ord. 2-2023 § 1 (Att. A), 2023; Ord. 2-2003, 2003.)
